Lasting Power of Attorney

The LPA is an important estate planning tool for dealing with mental incapacity

WHAT IS AN LPA?

An LPA is a legal document that allows you to plan for who looks after you and who looks after assets when you are unable to do so due to old age, illness or accident.

Our estate planners will work with you to document down your wishes and intentions using an LPA and other associated estate planning tools.

PERSONAL WELFARE DONEE

The a personal welfare donee helps make decisions on behalf of the donor relating to matters such as where the donor should live and his daily activities.

This is an important role to choose in making your LPA and has to be a named individual only, not corporate entity,

PROPERTY & AFFAIRS DONEE

The property & affairs donee helps to make decisions on behalf of the donor relating to matters such as his bank account transactions and property.

This is the other important role in your LPA. This donee can either be an individual or a trust company.

Why you need an LPA

Benefits of an LPA

  • PROTECT YOUR INTEREST

The LPA allows you to plan in advance and make choices about the care you will expect in the event you lose mental capacity and are unable to express you wishes.

    AVOID COSTLY COURT PROCESSES

Having an LPA will help your loved ones avoid the complicated and costly legal process of applying for deputyship to look after you and your assets after you lose mental capacity.

    FASTER ACCESS TO CARE

With an LPA in place, your family member can immediately start managing your personal welfare and/or assets instead of being bogged down by the tedious deputyship process.
  • CHOICE OF DONEE

An LPA allows you to choose in advanced who will look after you and who will look after your assets if you lose mental capacity.

    ACCESS TO PROFESSIONAL DONEES

An LPA gives you the option of electing professionals to provide for your care if you do not have close relatives that you trust to look after you.

    INTEGRATED ESTATE PLANNING

An LPA can work in an integrated manner with a Living Trust to provide a comprehensive plan for your welfare as well as management of your assets.

Process

This is the process we use to help you draw up your Lasting Power of Attorney (LPA)

INITIAL CALL

We start with a "no obligations" call to understand your needs, to determine how we can meet your needs and to help you understand the overall process and estimated costs.

CONFIRM ENGAGEMENT

Once you are comfortable with the process and pricing, we will confirm the engagement with you by signing a Letter of Engagement and collecting a deposit payment.

FACT FIND

Next step is to understand and document your wishes and intentions. This will include determining which LPA form is suitable for you and gathering detailed instructions for Form 2, and other required estate planning tools.

REVIEW AND AMEND

After the Fact Finding process is done, a draft of your LPA and related estate planning tools will be made available for your review and clarification. Amendments can be made at this stage to accommodate changes in intentions.

FINALISE AND SIGN

Once the draft documents are approved, we will arrange to meet the LPA Certificate Issuer to certify the LPA. Any final payments will be made at this point.
