Digital Estate

Digital estate planning helps ensure that your digital assets—email, photos, social media accounts and other online tools—are properly managed and distributed in the event of your death or incapacity.

WHAT IS DIGITAL ESTATE PLANNING?

Digital estate planning is the process of managing and protecting your digital assets, including online accounts, digital files, and cryptocurrencies, in the event of your death or incapacity. It helps you ensure that your digital assets are properly managed and preserved, according to your wishes.

Our estate planners will work with you to develop a digital estate plan to ensure your loved ones have access to your digital legacy.

DIGITAL EXECUTOR

A digital executor is a person appointed in your digital estate plans that works with your Will-appointed executor to execute your wishes regarding your digital estate.

While not an official and legal appointment, it is still an important role to provide technical assistance to your primary executor.

MEMORANDUM OF ASSETS

A memorandum of digital assets is a document that lists your digital assets and instructions for how they should be managed and distributed in the event of your death or incapacity.

This document is separate from a will and can be updated more frequently than a will, as digital assets and accounts may change over time.

Why you need a Digital Estate Plan

Benefits of a Digital Estate Plan

  • FACILITATE ACCESS TO INFORMATION

A lot of our real lives are stored digitally online and in our emails, like statements of financial assets, bank accounts etc. Ready access to these information will greatly facilitate estate administration.

    AVOIDING FINANCIAL LOSS

Valuable digital assets like cryptocurrencies and online businesses can be irretrievably loss if proper plans to document their access are not put in place in the event of death or loss of mental capacity.

    PREVENTING LOSS OF SENTIMENTAL VALUE

Digital assets like photos and videos of your children's birth, first birthday party, first words etc are priceless. They can be lost permanently if credentials to their online storage is loss.
  • REDUCE RISK OF IDENTITY THEFT

Digital estate planning reduces the risk that your online accounts and identity are not hijacked by malicious actors for nefarious uses when you are no longer around to detect such compromises.

    MAINTAIN CONFIDENTIALITY

Your digital estate plan can include instructions to remove your online footprint as much as possible to maintain your confidentiality after your demise.

    COMPLYING WITH RELEVANT REGULATIONS

Digital estate planning can help ensure that an individual's digital assets are managed in compliance with relevant laws and regulations, such as data privacy laws and regulations governing cryptocurrencies.

CONFIRM ENGAGEMENT
